Privacy Policy

This Privacy Policy explains how Stingray Expedite, LLC ("Stingray," "we," "us," or "our") collects, uses, shares, and protects information in connection with the OTEC Carriers app (the "App"), the mobile component of our Nautilus™ logistics platform.

The App is provided by Stingray Expedite, LLC and is used by Owner Operators ("OOs" or "OPRs") and operational staff who are contracted with OnTime Expedite Carriers (a Jodiel Delivery LLC company; USDOT 4535043 / MC 1813569). Stingray operates the App and its supporting platform; OnTime Expedite Carriers is the carrier on whose behalf the App is used.

By creating an account and using the App, you agree to the practices described in this Policy. If you do not agree, do not use the App.

1. Who this Policy applies to

The App is a business tool for independent contractors and staff working with OnTime Expedite Carriers. It is not intended for the general public and not directed to children (see Section 11). You must be at least 18 years old to use the App.

2. Information we collect

We collect the following categories of information. The specific data depends on your role and how you use the App.

a. Information you provide during onboarding and use

  • Identity and contact information: full name, email address, phone number, preferred language, and your current city, state, and ZIP code.

  • Business information (Owner Operators): company name, LLC name, EIN (Employer Identification Number), company address, and account type.

  • Payment and banking information: bank name, bank account number, and routing number, and W-9 status. This information is used to process contractor settlements through our factoring provider (see Section 5).

  • Vehicle information: make, model, year, color, license plate, VIN, vehicle type, and vehicle photos.

  • Compliance and identity documents, which may include: certificate of insurance (COI), driver's license, motor vehicle record (MVR), drug test results, vehicle registration, passport, permanent resident card ("green card"), and work authorization documents, along with their issue/expiration dates.

  • Agreements: Independent Contractor Agreement (ICA) status, signature timestamp, and signed document.

b. Location information

When you set your status to "Active" in the App, the App collects your device's precise GPS location. We use this to:

  • show your real-time position to authorized dispatch and tracking staff for load coordination and safety; and

  • match you with available loads whose pickup is within a defined distance of your current location.

You control location collection through the App's status toggle and your device permissions. If you turn off location sharing or set your status to inactive, real-time location is no longer collected, though your last recorded position may remain visible to authorized staff until updated.

c. Photos and documents

The App collects photos and files you submit as part of operations, including Proof of Delivery (POD) photos, cargo securement photos, Bills of Lading (BOL), and uploaded compliance documents.

d. Communications

The App includes in-app messaging between Owner Operators and dispatch/tracking staff. We collect the content of these messages, along with sender, timestamps, and delivery status, to coordinate loads and maintain an operational record.

e. Information collected automatically

When you use the App, we may automatically collect device and usage information, such as device identifiers, app version, log data, and general diagnostics, to operate, secure, and improve the App.

3. How we use your information

We use the information we collect to:

  • create and manage your account and verify your eligibility and compliance status;

  • assign, dispatch, track, and document freight loads;

  • match Owner Operators with nearby available loads;

  • communicate with you about loads, operations, and your account;

  • process contractor settlements and payments;

  • maintain an auditable operational record (e.g., POD, securement, and delivery documentation);

  • monitor and improve the performance, reliability, and security of the App; and

  • comply with legal, regulatory, tax, insurance, and safety obligations.

4. Legal and operational basis

We process this information to perform our contract with you (the Independent Contractor relationship), to comply with legal and regulatory obligations applicable to motor carriers, and for our legitimate business interests in operating a safe, documented, and auditable logistics operation.

5. How we share your information

We do not sell your personal information. We share information only as needed to operate the App and our logistics services:

  • OnTime Expedite Carriers: As the carrier you contract with, OnTime and its authorized dispatch, tracking, compliance, and administrative staff access your operational data (location, loads, documents, communications, and compliance status).

  • Payment / factoring provider: Your banking and settlement information is shared with our factoring provider to process contractor payments.

  • Brokers and shippers (limited): Limited load-related information (such as status updates and estimated arrival times) may be shared with the broker or shipper for a given load. We do not share your banking or personal identity documents with brokers.

  • Service providers: We use trusted third-party providers to host and operate the App and platform (see Section 6). They process data on our behalf under contractual confidentiality and security obligations.

  • Legal and safety: We may disclose information where required by law, regulation, legal process, or to protect the rights, safety, or property of Stingray, OnTime, our users, or the public.

  • Business transfers: If we undergo a merger, acquisition, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.

6. Third-party service providers

The App relies on the following categories of service providers, which may process certain data on our behalf:

  • Cloud database and file storage (platform backend and document/photo storage).

  • Mapping and geocoding services (to display locations and calculate distances).

  • Authentication services (to sign you in securely).

  • Mobile application infrastructure (app delivery and supporting services).

  • Payment / factoring services (to process settlements).

Each provider's handling of data is governed by its own terms and privacy practices in addition to our agreements with them.

7. Data retention

We retain your information for as long as your account is active and as needed to provide the App, and afterward as required to meet legal, regulatory, tax, insurance, and safety record-keeping obligations applicable to motor carrier operations (which may require retaining certain records, such as delivery documentation, for multiple years). When information is no longer required, we delete or de-identify it.

8. Your rights and choices

Depending on your location, you may have rights to:

  • access the personal information we hold about you;

  • correct inaccurate information;

  • request deletion of your personal information; and

  • control location sharing through the App's status toggle and your device settings.

To exercise these rights, contact us using the details in Section 13. We will respond as required by applicable law. Note that some information must be retained to meet the legal obligations described in Section 7.

9. Account and data deletion

You may request deletion of your account and associated personal information by contacting us at info@stingrayexp.com. Upon a verified request, we will delete or de-identify your personal information, except information we are legally required to retain (see Section 7). We will confirm completion of your request.

10. Data security

We use administrative, technical, and physical safeguards designed to protect your information, including access controls that limit data to authorized roles. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children's privacy

The App is intended only for adults (18+) working in a business capacity with OnTime Expedite Carriers. It is not directed to children, and we do not knowingly collect personal information from anyone under 18. If we learn we have collected such information, we will delete it.

12. Geographic scope

The App is operated for logistics activity within the United States, and information is processed and stored in the United States.

14. Changes to this Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Policy.
